01. Acceptance and eligibility
These Terms of Use (“Terms”) are a binding agreement between you and Mateus Henrique Campos de Souza, the individual developer of Palete (“Developer”, “Palete”, “we”, “us” or “our”). They govern your access to and use of the Palete mobile application, website, content, features and related services (collectively, the “Service”).
By downloading, installing, accessing or using the Service, you confirm that you have read and agree to these Terms. If you do not agree, do not use the Service. If you use Palete for an organisation, you represent that you have authority to bind that organisation.
You must be legally capable of entering into this agreement. If you are under the age of legal majority where you live, a parent or legal guardian must review and accept these Terms and supervise your use. Palete is not directed to anyone who cannot lawfully consent to the processing required to provide the Service.
02. The Palete service
Palete is designed to help organise meals, recipes, routines, preferences, goals, shopping needs and food budgets. Plans and recommendations depend on the information you provide and may not reflect every dietary, nutritional, financial or practical factor relevant to you.
Features may vary by country, device, app version, subscription level and availability. Descriptions, screenshots and promotional materials illustrate the Service and do not guarantee that every feature will always be available.
03. Nutrition and wellness notice
Information in the Service is provided for general meal-planning and informational purposes. It is not medical advice, diagnosis, treatment, emergency assistance or a substitute for advice from a qualified healthcare professional.
Consult an appropriate professional before making decisions that may affect a medical condition, allergy, pregnancy, eating disorder, medication, nutrient deficiency or other health concern. Never disregard professional advice or delay seeking it because of information shown in Palete.
You are responsible for checking ingredients, allergens, portions, preparation, food safety and suitability. Food labels and supplier information control if they conflict with information in the Service. If you believe you are experiencing an emergency, contact local emergency services immediately.
04. Accounts and security
Some features may require an account. You agree to provide accurate, current information and to keep it updated. You are responsible for protecting your credentials and for activity under your account, except where applicable law provides otherwise.
Notify us promptly at contact@paletemealplannerapp.com if you suspect unauthorised access. Do not share verification codes, attempt to access another person’s account or create accounts using false or misleading information.
05. Licence to use Palete
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to install and use Palete on devices that you own or control, solely for lawful personal use. For an App Store download, use on other Apple-branded devices associated with your Apple Account, including permitted Family Sharing or volume purchasing, is governed by Apple’s Usage Rules.
The Service is licensed, not sold. No right, title or interest is transferred except for the limited licence expressly granted here.
06. Acceptable use
You may not, and may not help anyone else to:
- use the Service in violation of law or another person’s rights;
- copy, sell, rent, sublicense or commercially exploit the Service;
- reverse engineer, decompile or attempt to extract source code, except where law expressly permits it;
- bypass security, access controls, usage limits or purchase protections;
- introduce malware, automate abusive requests, scrape the Service or interfere with its operation;
- impersonate another person, misrepresent affiliation or use Palete to deceive or harm;
- upload content you do not have the right to use; or
- use outputs as the sole basis for medical or other high-impact decisions.
We may investigate suspected misuse and take proportionate action to protect users, the Service and third parties.
07. Your information and content
You retain ownership of information and content you submit, such as preferences, goals, meal records, recipes and feedback. You grant us a limited licence to host, reproduce, process and display that content only as needed to operate, secure, improve and support the Service in accordance with our Privacy Policy.
You are responsible for the accuracy and legality of your content. Do not submit confidential information belonging to others, unlawful material, or health information that is unnecessary for the feature you are using.
08. Purchases, trials and subscriptions
Palete may offer paid features, one-time purchases, free trials or auto-renewable subscriptions. Before purchase, the App Store purchase screen will show the product, price, billing period, trial terms and included benefits. Those displayed terms form part of this agreement.
- Payments made through the App Store are charged to your Apple Account and processed by Apple under its Media Services Terms.
- An auto-renewable subscription continues for successive periods unless cancelled through your Apple Account subscription settings before renewal, as described by Apple.
- A free trial may convert to a paid subscription at the displayed price unless cancelled before the trial ends.
- Cancelling normally stops future renewals; access may continue until the end of the paid period. Deleting Palete does not cancel a subscription.
- Refunds, billing disputes, taxes and price-change consent are handled by Apple and applicable law. You can restore eligible purchases using the functionality provided in the app.
Current subscription details shown at purchase take precedence over general examples on this website. Paid features must provide the ongoing value described at the time of purchase.
09. Apple App Store terms
This section applies when you obtain Palete through Apple’s App Store. You acknowledge and agree that:
- these Terms are between you and Mateus Henrique Campos de Souza, not Apple; the Developer, not Apple, is responsible for Palete and its content;
- Apple has no obligation to provide maintenance or support for Palete;
- to the extent Palete fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation regarding Palete;
- the Developer, not Apple, is responsible for addressing product, legal, regulatory, consumer-protection and privacy claims relating to Palete;
- the Developer, not Apple, is responsible for investigating, defending, settling and discharging claims that Palete or its use infringes third-party intellectual-property rights;
- you are not located in a country or region subject to a United States Government embargo or designated as supporting terrorism, and you are not listed on a United States Government restricted-party list;
- you must comply with applicable third-party terms, including your mobile carrier and Apple Media Services terms; and
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you after your acceptance.

10. Privacy
Our Privacy Policy explains how personal information is handled. It forms part of these Terms. Device and App Store permissions remain under your control through the settings made available by Apple and Palete.
If a feature requires consent or permission, you may decline or later withdraw it through the available settings. Some features may not work without information or permissions that are necessary to provide them.
11. Third-party services and content
Palete may rely on or link to third-party services, ingredients, retailers, recipes, payment systems or platform features. Third-party services are governed by their own terms and privacy notices. We do not control their availability, accuracy, prices or practices.
References to third-party products do not imply endorsement. You are responsible for reviewing the current information supplied by a food manufacturer, retailer, professional or service provider before relying on it.
12. Ownership and feedback
Palete, including its software, design, branding, text, graphics and other materials, is owned by Mateus Henrique Campos de Souza or the Developer’s licensors and is protected by intellectual-property laws. These Terms do not grant you rights to our trademarks, logos or other brand elements.
If you send ideas or feedback, you allow us to use them without payment or restriction, provided that we do not publicly identify you as the source without permission.
13. Updates and availability
We may update Palete to add features, improve performance, comply with law or address security and reliability. You may need to install an update or use a supported operating-system version to continue using some features.
We aim to keep the Service available, but do not guarantee uninterrupted or error-free operation. Maintenance, outages, platform changes and events outside our reasonable control may affect availability.
14. Suspension and termination
You may stop using Palete at any time. If account deletion is available, use the in-app process or contact support for instructions. Deleting an account and cancelling an App Store subscription are separate actions.
We may suspend or terminate access when reasonably necessary to address a serious or repeated breach, fraud, security risk, legal obligation or harm to the Service or others. Where appropriate and legally required, we will provide notice and an opportunity to remedy the issue.
Provisions that by their nature should survive termination remain in effect, including ownership, payment obligations, disclaimers, limitations of liability and dispute provisions.
15. Disclaimers and warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PALETE IS PROVIDED “AS IS” AND “AS AVAILABLE”. WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT AND NON-INFRINGEMENT.
We do not warrant that meal suggestions will meet every goal, preference, budget or health need, or that information will always be complete or current. Nothing in these Terms excludes warranties or remedies that cannot lawfully be excluded. Your statutory consumer rights remain intact.
16. Limitation of liability
To the maximum extent permitted by law, Mateus Henrique Campos de Souza and the Developer’s service providers will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, goodwill or business opportunity arising from the Service.
Where liability cannot be excluded, it will be limited only to the extent permitted by applicable law. Nothing in these Terms limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any liability that law does not allow us to limit.
17. Indemnity
To the extent permitted by law, you agree to indemnify and hold Mateus Henrique Campos de Souza harmless from third-party claims, losses and reasonable costs arising from your unlawful use of the Service, your infringement of another person’s rights or content you submit in breach of these Terms. This obligation does not apply to the extent a claim results from our own acts or omissions.
18. Governing law and disputes
Before starting a formal dispute, please contact us so we can try to resolve the matter. These Terms are governed by the laws of Brazil, without regard to conflict-of-law rules, except that mandatory consumer protections and rights in your country or region continue to apply.
Courts with jurisdiction under applicable law may hear disputes. These Terms do not require you to waive a right to bring a claim before a competent consumer authority or court where such a waiver is prohibited.
19. General terms
These Terms, the Privacy Policy, Apple’s Standard EULA for App Store downloads and any purchase terms shown at checkout form the entire agreement concerning the Service. If terms conflict, mandatory law controls first, followed by Apple’s terms for App Store licensing and billing, the purchase terms for the relevant product, and these Terms.
If any provision is unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will stay in effect. Failure to enforce a provision is not a waiver. You may not transfer this agreement without our consent; we may transfer it as part of a merger, reorganisation or sale of the relevant business, subject to law.
20. Changes to these Terms
We may update these Terms to reflect changes to Palete, law or our operations. We will update the effective date and provide additional notice when required. Material changes apply prospectively. Continuing to use the Service after an updated version becomes effective means you accept it, unless applicable law requires another form of consent.
